This Risk Disclosure Statement (“Statement”) is an integral part of the User Agreement and applies to all persons who access or use the ETERNA Platform (the “Platform”). Before using the Platform, you must carefully read this Statement. By using the Platform, you acknowledge and accept all risks stated herein. This Statement does not disclose all risks associated with the use of the Platform. The User fully assumes responsibility for any decisions made using the Platform and any resulting outcomes.
The Platform Administrator does not provide investment advice, asset management services, brokerage services, custody services, or fiduciary services of any kind. Any information, strategies, parameters, performance statistics, calculations, indicators, market commentary, analytics, signals, reports, or other content provided through the Platform:
- does not constitute investment, financial, legal, tax, or accounting advice;
- is provided solely for informational and analytical purposes;
- must not be relied upon as a recommendation to engage in any financial activity.
You acknowledge that you make all decisions independently and at your own risk.
Financial markets are inherently volatile and unpredictable. Any trading results derived from strategies connected to the Platform may fluctuate substantially.
You understand and accept that:
- past performance is not a reliable indicator of future results;
- market conditions may change rapidly and without notice;
- performance simulations or hypothetical results may not reflect actual outcomes;
- liquidity constraints may prevent the execution, closure, or modification of strategies;
- significant losses may occur, including the potential loss of the entire balance.
The Platform Administrator makes no representations or guarantees regarding profitability, continuity, availability, or success of any strategy.
The Platform operates through software and network infrastructure, which may be subject to:
- system failures or interruptions;
- hardware or software malfunctions;
- internet outages or network latency;
- cyber attacks, malware, data breaches;
- unauthorized access or account compromise;
- delays in data transmission or processing;
- errors in calculations, metrics, or display.
The Platform Administrator is not liable for any damages, losses, or missed opportunities resulting from technological disruption or system malfunction.
You are solely responsible for:
- maintaining confidentiality of login credentials;
- safeguarding authentication devices;
- monitoring your activity and balances;
- detecting unauthorized access or misuse;
- verifying correctness of displayed information;
- ensuring compliance with all applicable laws.
Any activity performed under your account shall be deemed as initiated by you.
Laws governing financial activity, digital platforms, and taxation vary by jurisdiction and may change at any time. You acknowledge and accept:
- legal restrictions may apply in your jurisdiction;
- regulatory interpretation may change unpredictably;
- transactions may be reclassified under future laws;
- access to the Platform may become restricted;
- certain jurisdictions may prohibit your use of the Platform.
You bear full responsibility for determining whether access and use of the Platform comply with applicable law in your location.
The Platform Administrator is not a tax agent and does not provide tax consultation. You are solely responsible for:
- reporting earnings;
- determining taxable events;
- paying all applicable taxes and duties;
- complying with financial reporting obligations.
No information on the Platform constitutes tax advice.
If any values are displayed in currencies or digital units, currency fluctuations may materially affect outcomes. Displayed values are for convenience only and:
- do not represent stored funds;
- do not constitute digital assets;
- do not imply custodial ownership;
- are subject to conversion and valuation variability.
You acknowledge that using the Platform may involve:
- performance fees;
- service fees;
- referral commissions;
- third-party processing charges.
All applicable fees are disclosed separately. You are responsible for understanding the full cost structure before engaging with the Platform.
The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, the Platform Administrator:
- disclaims all warranties;
- will not be responsible for losses, interruptions, data errors, performance failures, or financial outcomes;
- will not be liable for indirect or consequential damages;
- limits any liability to the amount paid by the User during the previous one-month period (if any).
By accessing and using the Platform, you confirm that:
- you fully understand the risks;
- you act voluntarily and independently;
- no representations beyond official documentation were made;
- you waive claims based on market outcome;
- you accept technological, legal, and economic uncertainties.
If you do not accept any part of this Statement, you must immediately cease use of the Platform.
